WHAT EXACTLY IS A WASHINGTON STATE TRAFFIC INFRACTION?
We are often asked about the specific nature of a Washington State speeding or traffic ticket.  In the not so distant past, many traffic and minor conduct-related matters were simply charged as crimes. Over the years, our legislature in Olympia has decriminalized many of these offenses.  In most cases, they types of decriminalized matters related to driving, vehicles, traffic, parks, wildlife and fisheries offenses. Following the reclassification of these offenses, they are now legally known as infractions and are civil cases. 

The critical distinction between infractions and crimes is that infractions do not subject an alleged violator to any potential jail time.  Instead, the maximum penalty is fine.  In some instances, however, a failure to properly address and deal with an infraction can lead to a criminal charge down the road.  For example, if you have been issued a Washington State speeding ticket and choose to completely ignore it, then the matter will be defaulted and the infraction will be deemed to have been committed.  If you do not pay the fine promptly, the matter will also be sent to collections.

The Washington State Department of Licensing will also be notified.  Once the WA Department of Licensing is notified, they will eventually suspend your Washington State driver's license.  If you are then later stopped for another traffic infraction, you can be arrested and charged with Driving While License Suspended in the Third Degree (DWLS 3rd Degree), which is a criminal misdemeanor.  If you are later convicted of DWLS 3rd Degree, you could be sentenced up to 90 days in jail.  It is therefore critical to deal with driving-related infractions in a prompt and responsible manner.
