Any experienced WA traffic attorney will tell you that fighting and beating speeding and traffic tickets in Washington State has become a lot more difficult over the last few years.  In January of 2006, substantive changes were made to the Washington State Speeding and Traffic Ticket Court Rules. 

These are commonly referred to as the Infraction Rules for Courts of Limited Jurisdiction or IRLJs.   The simple truth is that several of the IRLJ changes implemented in January of 2006 made it more difficult and complicated to get tickets dismissed on purely procedural grounds.

We start off every case, however, believing that we will find a way to get your ticket dismissed outright.  And, in the majority of cases, we are successful in doing so.  Of course, this is no guarantee that we will get your infraction dismissed.  But the only fight truly lost is the one not undertaken.

How do we try to beat your WA State speeding or traffic ticket and attempt to get it dismissed?
There are many ways to potentially beat your Washington State speeding or traffic ticket and attempt to get it dismissed.  Our experienced infraction lawyers literally look for dozens of potential issues in every case.  We know the law.  We know the procedural rules regarding traffic tickets and infractions in Washington State.  And we know the courts. 

From procedural issues, such as the proper filing of your ticket and problems with the way it was written, to technical arguments regarding the proper testing, calibration and use of radar and laser speed measuring devices, we know what to look for and how to argue on your behalf.

We will use our knowledge of the Washington State speeding laws to your benefit.  When we start reviewing your police reports we always believe that we will find problems, and we usually do.  And, in the vast majority of traffic infraction cases, the only evidence against you is the citing officer's report.  If we find a fatal flaw in the officer's report, your violation will be dismissed.

Too many traffic tickets (moving violations)

What happens if I receive too many traffic tickets?
If you are ticketed for too many Washington State speeding tickets or moving violations within a specific period of time, a number of bad things can happen.

One of the worst things that can happen is that your license will be suspended by the Washington State Department of Licensing.  Additionally, even if your license is not suspended, you may be put on probation for a period of one year.  This means that your license is officially in a conditional status.

If you receive additional tickets during the probation period, your license will be suspended.

In addition to having your driving privileges suspended, your insurance rates are likely to skyrocket.

What does it take to get your license suspended?
If you are ticketed for 6 moving violations in any 12-month period, your license will be suspended for 60 days.  There is no probation period following the suspension.

What about probation (may lead to suspension)?

You will be put on probation, which is a conditional status for period of 1 year if you receive four or more Washington speeding tickets or moving violation traffic tickets during any 12 month period or if you receive five moving violations in any 24 month period.

During probation, if you are ticketed for 2 more moving violations your license will be suspended for 30 days for Continuing Offenses.

When you reinstate your license after the Continuing Offenses suspension, you will be placed on another year of probation. 

During the additional year of probation, if you are ticketed for 1 moving violation your license will be suspended as follows:

  • 60 days for a second suspension.
  • 120 days for a third suspension.
  • 364 days for a fourth or subsequent suspension.

How do I get my license back after being suspended?

To get your license back when this type of suspension is over:

In order to get your driving privileges reinstated, you must present the WA State Department of Licensing with a proof of financial responsibility (SR-22) insurance certificate.

You will also be required to pay a $75 re-issue fee the next time you apply for a driver license.


Can I get a restricted license while my license is suspended?

While your driver license is suspended, you may be eligible for an Occupational/Restricted License (ORL) that will allow you drive to work or other necessary appointments until the suspension is over.  If you have questions about whether or not you are eligible for ORL, please call our offices to speak with one of our experienced Washington State traffic attorneys.

Can I contest or appeal the suspension?

You may appeal the suspension within 15 days from the date on your notification letter. The letter we sent to you includes a form for you to appeal the suspension.

What will be considered during your appeal?  During your appeal, the Hearings Officer will only consider the following factors:

  • whether you received 4 moving violations in a 12-month period.
  • whether you received 5 moving violations in a 24-month period.
  • whether you received additional moving violations while on probation (conditional status).


What exactly is a Washington State Traffic Infraction?
We are often asked about the specific definition of Washington State speeding and traffic tickets.  Here's what you need to understand.  In the not so distant past, many traffic and minor conduct-related matters were simply charged as crimes.  Over the years, however, our legislature in Olympia saw fit to decriminalized many of these offenses. 

In the vast majority of cases, these types of decriminalized matters are related to driving, vehicles, traffic, parks, wildlife, and fisheries offenses.  Following the reclassification of these offenses, they are now legally known as infractions and are civil cases. 

The critical distinction between infractions and crimes is that infractions do not subject an alleged violator to any potential jail time.  Instead, the maximum penalty is a fine.  In most instances, however, it is important to know that a failure to properly respond and deal with a traffic infraction can lead to a criminal charge down the road. 

For example, if you have been issued a Washington State speeding ticket and choose to completely ignore it, then the matter will be defaulted and the infraction will be deemed to have been committed.  If you do not promptly pay the fine, the matter will eventually be sent to collections.

The Washington State Department of Licensing will also be notified.  Once the WA Department of Licensing is notified, they will suspend your Washington State driver's license if you continue to do nothing to resolve the matter. 

If you are then later stopped for another traffic infraction, you can be arrested and charged with Driving While License Suspended in the Third Degree (DWLS 3rd Degree), which is a criminal misdemeanor.  If you are later convicted of DWLS 3rd Degree, you could be sentenced up to 90 days in jail.  You are also subject to a $1,000 fine.  It is therefore critical to deal with all driving-related infractions in a prompt and responsible manner.
